Dear Mr. President:
This email is to register a strong protect against the visa bulletin released for Jun-09. In the tough time of 2009 that USA is facing, you are trying to do everything you can to protect the futures of the citizens of your country and I admire you for that. I would also like to point out that the visa bulletin pushes back dates for EB2 Indians to Jan-00 which virtually means no green card for Indians unless they are in EB1 category. I have spent almost 9 years in this country, legally. In 2005, I initiated the process for green card through EB immigration. While many others from different countries such as Europe, Asia and also China came here much after I have and contributed less than I have, they have gotten their green cards much sooner than I have and some of them have even become citizens. When I say I, a lot of my fellow citizens also face this unjust separate queue for Indians.
Please help me understand as to how someone from country A having a longer queue than country B coupled with an indefinite time wait is a fair and equitable treatment?

While opinions are good and welcome. My requirement is to see the exact INA language.
I have read the INA Sec 203 multiple times, I could not find the link between ebquota and ebdependents. May be I am missing it. Can some one show the exact lines in INA ?
Think about this "5 year old derivative kid" is counted in ebquota. How did the kid qualify for ebquota ? The law clearly says "to qualified immigrants who are aliens described in any of the following subparagraphs" and then goes on to say the exact qualification.
Don't take me out of context. I do want the kid to get greencard, however I am against the kid being counted in ebquota.
I am yet to get the access to ( I am a recent donor ) donor thread that refers the exact INA language. Can some other donor post the exact INA language in this thread ?

Few days ago, I saw this on TV - An American soldier died in Iraq leaving behind a 29 year old Polish wife and 6-month-old US citizen baby. Wife's paper (adjustment of status from K1->GC) was pending for 6 months or so with USCIS. When USCIS came to know about the death of that soldier (US citizen and I do not know how they came to know about it), they issued deportation order for his wife. Reason being, primary applicant is no more in this world so his dependent's application is null and void. She has been running from door to door with a baby in one arm and death letter of her husband with deportation order in the other arm. There is no one to listen to her. She lost her husband; she is going to lose her house and ability to stay in this country.
I absolutely hate to say this but Mehul, I think your wife will be better off in her home country. Please weight this option as well. My prayers are with you.

But please, just trying to beat around the bush is not going to help anyone here for that matter not just me alone. You suggestion of sending flowers seems like that is the only solution to all the problems. I would say the reversal of the July 2 visa bulletine didn't just happen because of the flowers the members sent, the law suit AILA wanted to file against USCIS was one of the major reason apart from the California's Lawmakers letter. I think it can not be true. I strongly believe in stats look around you and see how many have not received receipt, you will find very few numbers. In my office everyone has got receipt and my friends too. I am the only unlucky person. This sample is truly random hence I believe it. Out of 15 friends I know (work for different company and filed on different date) only I am left. Whatever immigartion-law or anyone is reporting like this is wrong.
It is painful to wait like this and I am frustrated.. hope next week brings some good news...

The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!
It is painful to wait like this and I am frustrated.. hope next week brings some good news...

If I am not wrong, it is more to do with a rule interpretation change by USCIS.
Insuppose the most feasible solution for the ones that are really bothered and have a chance is to do a EB2 porting. EB3 is like the slow lane. EB2 also used to be like that but benefited from the change in spillover.
EB3 best chance is to have the Visa Recapture which is already being pursued or have some other legislative fix.

Sanhari. I can very well understand the problems that you and every1 else face in EB3 category. But the way you are trying to put your case forward is wrong. By comparing with EB1 and EB2 priority dates you are just trying to show your frustration and not making a case at all. There is a reason they have different categories and similarly have priority dates for those. If you are eligible then port to EB2 else join IV with immigration reform or the latest fight to "Recieve EAD even if dates are not current". Please do not confuse teh congressmen or the senators who are already confused. Be proactive not jealous :cool:

Even if FB 2 almost has same priority date as EB 2 or 3 once the EB dependents quota gets counted against FB quota almost half of the EB backlog would move to FB which will cause progression in EB dates and retrogression in FB dates. Anyway I think simple1 point is definitely a good point and worthy of further discussion and clarification from attorneys.
