The DREAM Act is a bipartisan and narrowly-tailored bill that would allow undocumented immigrants who have completed two years of military service or college to petition the Secretary of Homeland Security for legal permanent residency. These individuals are required to have entered the United States prior to their sixteenth birthday, graduated from high school, and lived in the United States for at least five consecutive years.
As the Senate continues to work on the National Defense Authorization Act and its amendments, I will keep your thoughts in mind.

There were so many rejected L1 Individual petitions filed by TCS/Infy/Wipro etc.. These big companies will include all the internal tools in the resumes and INS asked for the purchase orders for all the specialised tools.
As there were no PO's for those tools, petitions were rejected in large numbers. This has started in the last year and continuing... i personally have lot of friends whose petitions were rejected and went back to India..

that Senior Members would be more involved in posting on this website. It makes a lot of difference if core members who have a closer perspective of the truth could respond to some questions on these threads. No response, in my opinion only helps in making the website dead and promotes unproductive arguments and squabbles here.
It is "good" that they are not talking. That means they are working harder and something good is expected to happen.
If there is more talk then outcome is less. This is my experience from past one plus year from IV and other immigration forums. When everyone get "too much" excited and keep posting madly about some "immature deal", at the end of the day nothing "concrete" is achived.
Let IV do their work. I am hopeful something "good" will happen in near future.

my lawyer just faxed me my I-485 receipt.
Center: NSC
RD: 26th July (sent on 25th July)
ND: 22nd Aug
140 was approved at NSC. No LUDs on my approved I-140 or H1s.
Attorney sent his checks, so don't know whether those checks are cleared or not.
Even though I applied 485, AP, EAD for me and for my wife in the same package, we
received receipt for only my I-495. Hey, I'm not complaining. Just passing this info to you guys.
Wow, this is good news...nearing my July 31st file. :D

I heard in yesterday radio talk show (with PA congressman) that a new group formed by house representatives (congressmen) called "representatives for legal immigration" (exact name not known because they said they are constructing a new website too), looks like, they oppose the illegal and support legal immigration. nt sure whether they will be of any help atleast during STRIVE bill debate to bring some relief to EB.

Problem: USCIS is not following FIFO
Why are they not following FIFO: Becoz they don't want to waste visa's. If I am USCIS what am I supposed to do. If I waste visa I get smacked. If I try to use up visa I get smacked ;) So what am I supposed to do with the limited resources:confused:
SOLUTION
Provide a provision for USCIS to automatically recapture unused visa's - this will give USCIS a buffer so that they don't act crazy in the last quarter - This provision already exists in HR 5882, this benefits everyone
Short Term - Gather a group of affected ppl and meet with USCIS and Immigration subcommittee chair's and present the issue and let Congress put pressure on USCIS to follow FIFO.
Note: My understanding is that USCIS is not doing any unlawful thing (guidelines aren't a law) by not following FIFO, but however it is unfair.

It is a shame to see high-skilled folks stoop to such low-levels (EB2-3 fights) just to get a card. Please have basic etiquette - respect for fellow professionals. EB1/EB2/EB3 is just a classification based on job description, America needs every category, so please respect those category members. Every category is inter depended on each other. For example: don't tell me that an EB1/2 fellow doesn't require EB3 folks for his/her professional growth.
Please stop this EB1/2/3 category fights and focus on a long lasting solution to the retrogression problem.
Let us have a healthy debate to solve the problem rather than fighting over silly comments..

While your story is interesting, but I beg to differ again, because, immigration is not something which would be discussed in the Congress for the first time, if we are successfull in bringing something. Each and every single lawmaker in this country understand immigration to the extent that you may not even start to guess...People who oppose us have been putting their restrictive bills again and again so they are going to continue doing that despite of us do something or sleep, do you think Numbersusa wait for us to do something, their anti.... mill will keep churning.
Sometimes you have to see the other perspective rather than just defending a point of view.
Now is not a good time for immigrants. The EB5 investor visa, which is a no brainer in this economy has been kicked on like a can for 6 mths at a time, congressmen that are pro- immigration are laying low. Anti-immigrant forces are gearing up for a big assault in coming weeks, the American public is unsympathetic given their own issues. Against this backdrop why would we launch such an effort. Basically now is the time to play Defense not Offense. Do all you can to hang on to your job, keep your savings liquid. Wait for any opportunities to arise, and wait for the storm to pass.
After the great depression, this country virtually shut down immigration for the next few decades. Likewise they slowed it down in the early 80s and again in the early 90s. Right about now, no change is a good thing IMHO, as bad as that sounds, as change will not be in your favor.

I absolutely agree with you. One of my cousin is unfortunately suffering in EB3 for years he is a MS and working for over 10 years, he has been trying to port to EB2...but his attorney flatly refused on grounds that the company doesn't need a advanced degree applicant for that position and they can't justify the same to USCIS and invite scrutiny especially in this economy.
Ofcourse porting is blessing for lawyers and it means greenbacks for them the more the better.

I got an email today from USCIS stating this
Current Status: Card production ordered.
I did not receive any other approval notice. I hope this means that our 485 is approved and the cards have been ordered ?

Each IO has given me different info on different calls. Whatever they say about visa number cannot be considered true. Just say ok and move on or call back to get a different answer.
